In celebration of all things Irish we are looking at how SDS regulations differ in Republic of Ireland, Northern Ireland, and Great Britain. As we prepare our bundles of fresh shamrock for St. Patrick’s, it's a perfect time to tour the SDS landscape across the regions that share deep historic and cultural roots, and now, different SDS regulations.
The SDS Shamrock:
Think of SDS compliance across these regions like a shamrock; three petals, each connected, but each with its own shape.
Three Petals: Republic of Ireland, Northern Ireland, and Great Britain
The island of Ireland is split between two different jurisdictions. The Republic of Ireland is part of the European Union, while Northern Ireland is part of the United Kingdom which separated from the EU in 2020. With the UK separation from the EU, the UK has created regulations independent from the EU, creating important implications for SDS compliance.
European Union (including the Republic of Ireland)
EU SDS regulations are governed by:
- REACH Annex II and
- EU CLP Regulation (EC) No 1272/2008
These regulations define the requirements for Classification, Labeling, and Packaging of chemicals, including information on compiling SDS, across all EU member states, including the Republic of Ireland.
United Kingdom (Great Britain)
Post Brexit, the UK created:
- UK REACH
- GB CLP (mirrors the EU system but now operate independently)
- GB Mandatory Classification List (GB MCL)
The UK now maintains the GB MCL. While initially aligned with the EU, this list can diverge overtime as UK reviews substances independently.
Northern Ireland
Although part of the UK, Northern Ireland stays aligned to EU regulations to keep the Irish border open under the Northern Ireland Protocol:
- EU CLP Regulation (EC) No 1272/2008
For SDS purposes, Northern Ireland effectively follows EU rules rather than GB rules.
What does this mean for chemical manufacturers and importers in the UK and EU?
These jurisdictional differences aren’t just academic, they have real-world impacts on compliance strategies.
1. Dual SDS authoring
If your products travel like wandering Celtic storytellers, from Great Britain to Northern Ireland to Republic or Ireland, you’ll need more than one SDS version:
- EU compliant SDS for Republic or Ireland and Northern Ireland
- GB specific SDS for Great Britain
2. Poison Center Notifications (PCN) and Unique Formula Identifier (UFI): Only in the EU
- Republic or Ireland and Northern Ireland require Poison Center Notifications (PCN) and UFI codes under EU CLP Annex VIII.
- GB does not require EU PCN or UFI.
- GB handles emergency info via National Poison Information Service (NPIS) with voluntary SDS submissions).
So UFI is like a traditional Irish tune, you’ll hear it played in Dublin and Belfast, but not in London.
3. Supplier address requirements
- EU SDS must list an EU based supplier/importer/distributor.
- GB SDS must list a UK based supplier/importer/distributor.
EU addresses are no longer compliant for GB SDS, making careful document management essential for companies operating on both sides of the Irish Sea.
4. Classification divergence over time
- EU will continue to make amendments and changes to EU CLP Regulations
- Great Britain reviews data separately and may classify products differently than the EU, which may cause differences between EU and GB SDS.
The Pot of Gold: What Companies Must Do
To stay compliant while celebrating both Irish and UK markets:
- Maintain two SDS: EU SDS (for Republic of Ireland + Northern Ireland) and GB SDS (for Great Britain only).
- Track classification changes in both EU and GB systems.
- Include UFI + PCN only for EU and Northern Ireland.
- Use the correct supplier address depending on jurisdiction.
Follow these steps, and your compliance program will be as steady as a traditional Irish reel whether your products travel to Dublin, Belfast, or Birmingham!
